1. Introduction
These Terms and Conditions ("Terms") govern your purchase and use of the products ("Products") available through our website or other sales channels. By purchasing Products from us, you agree to be bound by these Terms.
2. User Agreement
By ordering Products from us, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, then you are not permitted to order Products from us.
3. Product Information
We endeavor to be as accurate as possible in describing our Products. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free.
4. Pricing and Payment
Prices for our Products are subject to change without notice. We reserve the right at any time to modify or discontinue the Product (or any part or content thereof) without notice at any time.
5. Shipping and Delivery
Products will be shipped in accordance with the shipping method you select at checkout. We are not responsible for any delays in shipping.
6. Returns and Refunds
All art is made to order hence all sales are final. Wood, as a natural material, has inherent distinctions and variations in grain, pattern, texture, color, with each piece being unique. These natural variations are not flaws or defects; instead, they contribute to the unique beauty and richness of each of our products. While we strive for consistency, we cannot guarantee that each item will be identical to what is shown in images or previous orders. By purchasing our products, you acknowledge and appreciate these natural variations and agree that they are not considered as defects.
7. User Responsibilities
You agree to use our Products safely and in accordance with any instructions provided. You agree not to use our Products in any way that could cause harm to yourself or others.
8. Limitation of Liability
In no event shall VON LIV, partners, suppliers, or affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Products or for any other claim related in any way to your use of the Products.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions.
10. Privacy Policy
We are committed to protecting your privacy. We do not sell, trade, or otherwise transfer your personal information to any third parties or affiliates. Your data is used solely to provide you with the best possible service, and we take every precaution to ensure that your information is kept secure and confidential. By using our services, you agree to this policy and trust that your privacy is our priority.
11. International Customer
International customers are responsible for any customs duties, taxes, or import fees their country may require. Those fees are not included in your order total.
12. Chargeback & Fraud Prevention Policy
If a customer initiates or attempts to initiate a chargeback or payment dispute while an order is in production, shipment of the order will be immediately paused until the chargeback or dispute is fully resolved and removed. This policy is in place to help prevent fraudulent transactions and protect both parties involved. Delays caused by payment disputes may impact estimated shipping and delivery timelines.
13. Changes to Terms
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes. It is your responsibility to check periodically for changes.
Terms and Conditions for VON LIV Custom Orders
By uploading an image or design to be used in the creation of your custom wall art, you (“the Customer”) agree to the following:
1. Ownership & Rights
You represent and warrant that you own, control, or have obtained the necessary rights, licenses, or permissions to use, reproduce, and distribute the image(s) you upload.
You further confirm that your uploaded image(s) do not infringe on any copyright, trademark, publicity, privacy, or other intellectual property rights of any third party.
2. Customer Responsibility
You are solely responsible for the content of the image(s) you upload.
VON LIV does not verify the ownership or rights of uploaded images and relies entirely on your representations.
3. Limitation of Liability
VON LIV will not be held liable for any claims, damages, losses, or expenses (including legal fees) arising from or related to the use of an image provided by you.
If a third party makes a claim against VON LIV regarding an image you submitted, you agree to indemnify and hold harmless VON LIV, its owners, employees, and affiliates from any such claims.
4. Right to Refuse
VON LIV reserves the right to refuse to produce any image that is deemed offensive, unlawful, or otherwise inappropriate at its sole discretion.
